Dear Plot holder,


You are well aware that unauthorized encroachment /illegal construction is going on at Okhla Enclave Phase-I/II unabatedly despite of our repeated complaints to Police/Govt  agencies of Faridabad, Haryana, as a result of which Enforcement Director has demolished the illegal construction but in view of recurring encroachment it appears  the law enforcing agency is succumbing to or in nexus with the land mafia. Occasional demolitions make no lasting impact and serve only a mere eye-wash.

The matter relating to spilling over of sewerage water in Phase-I plots have already been taken up with the Pollution Deptt  as well as Municipal Commissioner Faridabad. We earnestly hope that  requisite action will be taken in the matter by the competent authority very shortly. 

In view of the above, Hon’ble Supreme Court petitioners are again requested to get their building plans passed. Those who have got the building plans, they may start construction of their houses, in case of any difficulty they may give their feedback to the Association to seek necessary relief through directions from the Hon’ble Supreme Court in the ensuing hearings. Construction of  boundary wall of their plots is immediately required to ward their plots from encroachment. Local Civil authorities will be requested for all assistance in the matter.

                It is learnt that some unauthorized/illegal  construction/possession activities  are taking place in Phas1 & II Okhla Enclave, Sector 91, Faridabad, Haryana. The colonizer has allotted plots of various categories to various persons, among which our members also fall. It is difficult to say which of the construction is illegal/unauthorized. Colonizer has filed  complaints of unauthorized/illegal encroachment/possessions with Police Commissioner Faridabad, Haryana; we have also lodged a general complaint with the Police Commissioner, Faridabad .

            You are also well aware that in January/February 2012 such unauthorized/illegal activities was noticed and at that time necessary steps were taken by the Association with your co-operation. Our delegation of members met police authorities and with our rigorous efforts such activities were stopped.

            Recently, such information was again received by the Association and immediately the matter was brought to the notice of Police Commissioner as well as various Govt authorities.  In response to our complaint, we got telephonic message from Shri Brahm Prakash, ASI to intimate the particulars of plot on which such activities have taken place so that further action be taken at their end.

            Few days back we visited at site and met again to concerned Police Officer/letters have also been sent to authorities concerned to remove such occupancy and they assured us for doing the needful as per law and intimation from the specific owner of plot.

            Keeping in view the police message, we advise our members to please visit the site of their plot and check the location of your plot and if there is any illegal occupancy on your plot, please intimate the police post in writing with a copy to Association for further action in the matter. If you feel any difficulty to locate your plot, please contact Shri Purshotam, Caretaker of Company at site.  In case of any non-cooperation by him, you may contact Association immediately.

            We hope you will keep watch on your plot for any unauthorized/illegal encroachment/occupancy. 
             
             We have also prayed  the Hon’ble Supreme Court of India for an  early hearing.

                                                       GENERAL NOTICE

At the earliest opportunity this Association got the registration of all plot holders belonging to almost all Supreme Court petitioners at the minimum of cost. This matter was pending for years despite orders of Hon’ble Supreme Court of India. At this accomplishment, many members got thrilled and impatient to build their houses there without following the process. Instead of waiting for the judgment on the pending case and moving through Association, a crazy group got desperate and started mobilizing people about getting the development done there through leaders of Haryana.

They assembled at different places meeting authorities and political leaders without any tangible results. Earlier, we had made efforts to approach them and despite of courts’ orders & affidavits/statements of Colonizer, we were compelled to knock the door of Hon’ble Court again.

The Association called Sh. Kaplesh with a few of his associates for meeting and hear their views on 13th May, 2012 at Sanjay Park. They came with a strong group with their spokesperson Sh.Malhotra who enquired why even after the orders of Hon’ble Supreme Court in 2007 to help them build their houses the area is devoid of any development.. Gen. Secretary Sh. Pandey gave an account of legal or other hurdles, appointment of Court Commissioner to enquire into given terms of reference and after due enquiry Court Commissioner has submitted his report which is in the process of hearing in Hon’ble Supreme Court. In opinion of our Legal council, until the case is not disposed off by the Hon’ble Supreme Court, no authority can ensure development.  However, if our friends make efforts from any other sources, we welcome  it but such activities should also be brought to the notice of association .

The approach of the Association is step by step and systematic, both in case of legal fight and getting the building plans sanctioned. In the case of Supreme Court petitioners, once this is done, Hon’ble Supreme Court may be moved for passing appropriate order to appropriate authorities for development through our Ld. Advocates.

The Supreme Court petitioners may be slightly in an advantageous position but development can not be done selectively for these petitioners only. It has to be done considering all the cases from all aspects in totality for the entire colony.

The opinion of our said members  to include them in the Executive of Association, either by direct entry or through Advisory Committee, was placed before the Executive Body in its meeting dated 19th May 2012 and decided that present bye laws of Association do not provide for it. They will have to wait for next elections to become the member of Executive Body. We of course welcome creative / positive suggestions from our members. We also do not see any emergency to induct the said persons into Executive mid-way.

We appeal members to remain patient and united. Definitely we will reach our goal at the earliest. The more we are united, the stronger will be our fight for triumph of truth and realization of aspirations of dream houses.

Members have been intimated about all the activities of Association  in AGM held on 04-12-2011  along with the Hob’ble Apex Court direction  to Govt. Haryana  to clear the building plans of licensed colony  for plot holders cleared by Supreme Court. It was also made clear that all members desirous of sanction of building plans,  may individually or collectively contact the architect. Recently the Gen. Secretary, Sh. Vijay Bhushan & Sh. B S Sharma, both Executive Members are in talk with an Architect at Faridabad on behalf of our  Supreme Court petitioners. The architect has demanded Rs. 18,800/- for the job bifurcated as under:
 
            Land Tax          -          Rs. 2800/-
            No Dues          -           Rs. 1500/-
            Plan Fee           -           Rs. 1000/-
            Structural Stability
            Certificate         -           Rs. 1500/-
            Architects +
            Misc. expenses-             Rs.12000/-

After long discussion & pressure the said payment was consolidated Rs. 18000/-

NOTICE

It is brought to the notice of Association that unauthorized construction/occupancy is being done on the plots of "J"Block, Sector-91, Okhla Enclave. The Association has already filed the complaint with the concerned police station.

On Ist Feb 2012, it is decided at site that all supreme court petitioners of "J"Block should occupy their respective plots in safety point of view. However, Shri Purshotam, Caretaker of Durga Builder (P) Ltd will be available at site on 05-02-2012 at 10.30 AM for the purpose. This is for all concerned.

Dear Sir,

All of you will be keen to know about progress of hearing in Hon’ble Supreme Court in the on going case. After a long gap the case was listed for 11.01.2012. On the said date it was listed as case # 10 but it didn’t come on board and was adjourned.. On 17.01.12 it came on board. Our Sr. Advocate dully assisted by his junior, vehemently pleaded the case for more than half an hour. He circulated brief history of the case to Justices & concerned Advocates. He pleaded that there are numerous I. A’s. by concerned Associations, groups or individuals in our case, these are required to be disposed off before a hearing on Court Commissioner’s report. As such, Hon’ble Justices directed that reply to various IA’s in the case may be filed within 8 weeks time. The case will be heard only after that.

There are more than 40 IAs in the case, most of them are by our sister Association, Durga Builders Plot Holders Welfare Association, collectively or individually, who for most of the cases did not get their claims verified by the Court Commissioner, despite of ample time having been given to them.

We would submit the requisite reply through our Advocate at the earliest.

The date of hearing in Hon’ble Supreme Court dated 11-01-2012 has now been re-fixed for 17th January 2012.

During the collection day of legal charges at Sanjay Park, some supreme court petitioner members desired that

a) boundary walls of allotted plots have been damaged and now there is no identification of their plots, which is required to be rebuilt.

b) submitting application for building plans of desired plots holders through to an Architect nominated by the Association.

President clarified that the Association is busy with court case but definitely the issue will be taken up in the interest of our members to the extent possible.

The matter of boundary was taken up with Shri Purshotam, Caretaker of M/s. Durga Builders (P) Ltd., who assured that the person concerned may contact him for the purpose His Cell No. is 9268890547.

Further the issue of building plan has also been discussed with various Architects and all of them wanted total number of members interested to get their building plans sanctioned. Under the present circumstances, building plans of the Supreme Court petitioners are being taken up by DTP, so the members interested to get their building plan sanctioned, may please inform the Association immediately.

Further, the members who have not paid their legal charges, may send it immediately, failing which no correspondence will be made with them.
