Dear Members,

As you have already been apprised through whatsapp, website as well as telephonic conversation that Hon’ble Apex Court has appointed former Supreme Court Judge Mr. Justice G P Mathur as Arbitrator in our case. All the parties are directed to approach Ld. Arbitrator for further necessary action in the case. The Ld Arbitrator shall first settle the terms of reference then, thereafter resolve the disputes as expeditiously as possible within nine  months from the date of submission of representation. On completion of arbitral proceedings, Ld. Arbitrator shall submit a report to Hon’ble Apex Court. Fees will be payable by all parties equally as decided by Ld. Arbitrator. The matter shall be listed thereafter.

We have to approach the Ld. Arbitrator with terms of reference ( brief of case together with our prayer to the Court) together with our list of members at the earliest. In our recent AGM we had proposed to collect from members legal charges @ Rs. 5000/- per member. Before we submit our terms of reference with list of members who have paid all dues as on date to the Ld. Arbitrator, we intend to give our members who have been cooperating with us earnestly throughout but have not yet cleared their dues so far, a chance to clear their dues immediately to enable themselves to be eligible to be considered as bona fide member of Petitioners’ Association.

We may further make it clear that if you fail to avail this chance to clear your dues, the onus of striking off your name from membership will be on you only, so please cooperate as ever and stand united.

Dear Members,


The case was heard by the bench of Hon’ble Apex Court on 10th Dec.’15 and passed the following order:

Having heard learned counsel appearing for the parties and taking into consideration the fact that these matters involve lengthy serious issues which need to be streamlined before resolving the same, we deem it fit and proper to appoint a former Judge of this Court as an Arbitrator to resolve the disputes involved between the parties.

As jointly agreed by the parties, we appoint Hon’ble  Mr. Justice G.P. Mathur, a former Judge of this Court, as an Arbitrator, to resolve each and every issues involved in these matters.  We pass this order on the submission made by one of the learned counsel appearing for the respondents that Hon’ble Mr. Justice G.P. Mathur, has given his consent to resolve the disputes involved between the parties.

Parties are directed to approach the learned Arbitrator for fixing the date and place of the arbitral proceedings.  Fee shall be decided by the learned Arbitrator and borne equally by all the parties.

All the parties shall submit their respective proposed terms of reference before the learned Arbitrator.  Learned Arbitrator shall first settle the terms of reference and thereafter, resolve the disputes involved between the parties as expeditiously as possible preferably within a period of nine months from the date the parties approach the learned Arbitrator.  On completion of the arbitral proceedings, learned Arbitrator shall submit a report to this Court.

List the matters on receipt of report of the learned Arbitrator.

Dear Sir,

The case was heard by the Hon’ble Court on 2nd & 3rd  Dec. ’15 respectively.  After hearing the parties, Court came to the conclusion that  matter is complicated and under the circumstances,   Committee of a Retired Judge of Supreme Court have to  be constituted.   All parties were directed to submit  Terns & Reference for the purpose.

All parties submitted their Terms & References on  3rd Dec. ‘15 and now the Court  directed that accepted/approved  Terms & References will be declared on  next week hearing.

Defaulter members are requested to clear their outstanding dues without any further delay.
