                               OUTSTANDING DUES  DETAIL AGAINST MEMBERS



Dear Members,

In reference to payment of legal charges as well as membership, number messages through SMS/Whatsap  telephonic calls and request during the AGM on 6th Sept. 2015 were made but still various member have not deposited their dues.  Our various respected member compelled us to place the name of such members on Association website as decided in the AGM dated 06 Sept. 2015 so that the member concern may know their actual dues.  However, the details of such members  are as below:

MINUTES OF ANNUAL GENERAL BODY MEETING

             The Annual General Body meeting of Okhla Enclave Plot Holders’ Welfare Association was held on 06-09-2015 (Sunday) at Hindi Bhawan, ITO, New Delhi to consider the following agenda Items:

1                                                                                                                                                                            1.      Welcome by the President of members present & briefing the case.                                                                2.     Suggestions/Comments of Members about the case and unity of Association.
      3.  General Secretary report about the activities of case.
              4   Audited A/cs for the year 2013-14 & 2014-15 along with income &                  expenditure.
     5.   Fixation of date for election of new Governing Body.
     6.   Any other point by permission of Chair.
     7.   Thanks by the President.

The minutes of the meeting are as under:

   1.            The President Shri SS Bhandari welcomed the members, nearly 223 members were present in the meeting, they were briefed about the present  status of case.  He stated that as per Order of Hon’ble Apex Court dated 17th/18th July 2013, the entire licensed land of Okhla Enclave was put at the custody of DGTCP, Govt.of Haryana, till final disposal of the case.  The lists of entitled persons have already been prepared by the Govt.  He also added that as per Order of Apex Court  dated 15th July 2015, all other petitioners, except those of  IA NO. 8 & 9 of 2007 in Writ Petition (CIVIL) of 1996, have been directed to report to appropriate court for relief.

            He added that the DGTCP in compliance of Apex Court’s order dt. 15.07.2015 filed affidavit on 2.09.2015 proposing uniform reduction in plot size of all NPNL allottees, except those of Supreme Court petitioners, to 84 sq.mts in place of their eligible plot sizes of 84 to 250 sq mts. He further stated that the proposal of Govt. is not feasible, however, the proposal will be examined by the Association and a suitable response to affidavit will be filed in the Court.

2.            Several members offered their views.  Shri Rakesh Malhotra stated that the Govt. does not want to resolve our problems.  He met personally to number of Govt.  Officers at various levels and despite of filing the case before the Court, Govt. did not show the interest to provide the civic amenities to the petitioners of supreme court allottees.   However, now  all we have to be united to achieve the goal.  Sh. BS Sharma  also suggested that the aim of our Association  is to sort out the problems of each member honestly  without any discrimination.  Shri RK Trivedi also advised the members that unity of all allottees  is must to sort out the problem, however all Association should come under one platform.  The accounts of our Association are very clear.  Shri OP Gupta a member of Association appealed to the member that we are fighting for the last  20 years, in view of this we should accept the proposal of 84 sq.mts to sort out the long pending issue.  Shri SP Kamboj and  various other members objected the said proposal with the plea  that the sale deed of supreme court petitioners was executed long back when they cleared their dues in 2000 whereas the original allottees had paid the required dues much earlier than the said petitioners.  Various members mentioned that they have paid all dues in 1995 and how they  can accept the 84 S.Mtr. plot. 

3.                     The General Secretary placed the detailed report before the General Body  about the activities of Association and time to time meetings held  with the Govt.  It is also added by him that every time unnecessary issues are being raised before the Court by our sister Associations  with connivance  of builder to confuse the court.   We personally met   Mr. SDR Chadha, President of Allottee Forum thrice at his residence but no solid action  on ground was taken by them despite assurances.  In addition to  Allottees Forum, we contacted to Durga Builder Association, Joint Action Committee & others  with the request that if our goal is one why we are fighting on different angles but all these were  determined not to co-operate on this issue, instead were bent upon to raise superficial issues to reap larger funds for them.  

            General Secretary assured the members that all efforts will be made for ensure justice and without any solid ground or Court Order, we will not accept the proposed offer of Govt.f 84 Sq. Mtr. Plot.

    It is also added by the General Secretary that the reply to Durga Builder  Chartered Accountant’s letter asking for plot related data from allottees  will be given by the Advocate of Association and the copy of same will be sent to member concern on their whatsap.

4.     On behalf of Treasurer, the General Secretary placed the audited accounts for the year 2013-14 & 2014-15  before the General Body as under which were unanimously approved by the General Body.

          It was also mentioned that the funds of Association has already exhausted and the balance of funds of petitioner members now stood at Rs.7.30 Lac, therefore, Executive Body decided to collect  Rs. 5,000/= from each member on account of legal charges immediately.  Some members suggested that members be directed to deposit their all pending dues before 10th Nov. 2015.

            The President Shri SS Bhandari requested to all members to clear their pending and current dues by above date so as to strengthen the financial position of the Association. The list of defaulter members will be placed on Association’s Blog after above date.

5.           About fixing of date for election of Governing Body, the General Body unanimously decided that the Existing Governing Body may continue for another year, except the Executive members not present in the General Meeting, Executive members, namely,  S/Sh. BM Sharma and Mohinder Singh were not present in General Body and following    members offered their services for Association to be included in the Governing Body:

1.   Shri SK Dabral
2.   Shri Sudhir Datta.
3.   Shri Sudhir Kumar.

In the end all members were thanked by the President, Shri SS Bhandari and requested them to continue to offer their valuable co-operation to Association in their own interest.

The members who attended the meeting, marked their presence on Attendance Register.

Dear Members,

The General Body Meeting is going to be held on 06th Sept. 2015 (Sunday) at 10.30 AM at Hindi Bhavan (NearBal Bhavan), ITO.  All members are requested to attain the meeting and clear their pending dues at the spot.

Number of telephonic call as well as e-mail are received about the recent letter of someone CA Rajiv Bansal about the details of allotted plots to plot holders.   We have already handed over the said letter to our Counsel for further action in the matter.  The advice of Counsel will also be conveyed in the meeting. No need of reply till such time the advice of Counsel is received.

After clearing the dues, please mark your attendance in Attendance Sheet with the request to check your name, address, Cell No. & e-mail and get a Token from same counter to enter in Meeting Hall.  In the end of meeting, please return the token and in exchange get a light refreshment box at the Gate of Meeting Hall.

Dear Members,

The detailed Order dated 15-07-2015 of Hon’ble Apex Court are as under:

“O R D E R
I.A. No. 13 OF 2014

Mr.V. Giri, learned senior counsel seeks permission to withdraw this application in order to move the appropriate forum.  The prayer is allowed.  I.A. No. 13, accordingly, dismissed as withdrawn.

We have heard learned counsel for all the parties including the learned counsel appearing in the write petitions as also in the other interlocutory applications.

At the very outset, we are not inclined to entertain these writ petitions and interlocutory applications, except Interlocutory Application Nos. 8 and 9 in Writ Petition (Civil) No. 876 of 1996, and to adjudicate their title in respect of the area where they alleged to have been in occupation. Those writ petitions and interlocutory applications are hereby dismissed.

However, the writ petitioners and the other petitioners who have filed interlocutory applications are give liberty to move the appropriate forum by filing suits/other proceedings for adjudication of their title and possession.

The interim order, if any, passed in these writ petitions and interlocutory applications shall continue to be in force for a period of three months so that they may file applications before the Court where suits or proceedings that may be filed and pray for interim relief.

It is made clear that while hearing the interlocutory applications or passing order, the Court concerned shall not be prejudiced by the orders passed by this Court.  We further direct that the suits or proceedings, if any, that may be filed by these persons shall be decided as expeditiously as possible, preferably within a period of one year.

So far as the interest of the petitioners in IA Nos. 8 & 9 is concerned, having regard to the orders passed by this Court on 1.7.2013, 10.7.2014 and 4.8.2014, before we finally adjudicate the matter, we direct the Director General (DG), Town and Country Planning to file a fresh affidavit giving the details of the land available, excluding the land alleged to have been occupied by the encroachers or persons claiming title and also under general category and to state how the persons who have been allotted as far back as in the year 1986 and thereafter shall be accommodated.

It has come from the Bar that it is the builder who is actually involved in the distribution of plots and also alleged to have been committed fraud by transferring the same plot to more than one persons.  The builder is, therefore, directed to file an affidavit giving his explanation and also to state as to how the persons interested shall be accommodated in the land.

In so far as those interlocutory applications filed by the persons other than the alleged encroachers or persons claiming title, they may, if so advised move the High Court for redressal of the grievance.

Put up I.A. Nos. 8 & 9 in Writ Petition (Civil) No. 876 of 1996 after six weeks.

Dear Members,

With best of your cooperation, we have been pursuing  our Case in the Hon’able Supreme Court of India consistently and vigorously since 1996. In this pursuit we earnestly tried to unite all Associations / groups to fight jointly to achieve speedier justice, despite assurances the false ego of involved leaders seemed to have deterred them to come under common umbrella for the benefit of all genuine plot holders. As such we spearheaded the solo fight braving all sorts of problems like resources crunch, sluggishness of delivery of justice but our ultimate aim of fighting for our rights despite odds kept us in the forefront.

With best of efforts of our learned Advocates, despite some deletions of hearing dates, our case was heard on 15th July, 2015, the ORDER is as follows:

“Upon hearing the counsel, Court made the following ORDER

I A No. 13 is dismissed as withdrawn.

All the writ petitions and interlocutory applications, except Writ Petition (Civil) No. 876 of 1996, are dismissed.

The interim order, if any, passed in these writ petitions and interlocutory applications shall continue to be in force for a period of 3 months.

Put up I A No. 8 & 9 in W P (Civil) No. 876 of 1996 after six weeks.

As evident from the order, only our Writ Petition is taken up for further adjudication in Apex Court, all other   W Ps / I As have either been dismissed or have been given liberty to be taken up in appropriate court. Earlier the Hon’ble Apex Court had appointed Amicus Curiae to prepare brief for the Court based on details furnished by the Registry, Amicus Curiae also established that our Association representing original allottees, has record of consistent fight.

The General Body meeting is being arranged to apprise you of all details of happenings, resource crunch, future course of action, etc. The defaulters are once again requested to deposit the dues without any delay.

Dear Members,

            Lot of calls are being received from the Association members regarding the date of hearing on 8th July, 2015.  Earlier the date of hearing was being shown 8th July 2015 in the advance list of court  but later on our case was deleted from the final list. 

            The above information has already been supplied to all those members who are attached with the Association through WhatsApp.

            Again the date was being shown on 15th July ’15 which again removed. Now we are waiting the final list of next week cases.    It is also added that as & when the case will be heard by the Hon’ble Court, necessary information will be made available to members through this site as well as on WhatsApp.

            Various members have not deposited their legal charges due against them despite of repeated request as well as their names had also been placed in the website of Association.    In future, we will be unable to present our advocate before the court on the due date in case of insufficient fund. We would also like to add here  very clearly  that the Association will be helpless to favour the defaulter members in case of any final judgment/orders comes out.

            M/s. Durga Builder requested before the Hon’ble Court  on 01-02-2014 that 150 plot holders’ (supreme court petitioners) have not deposited  their dues and the Hon’ble Court passed the order to Associations to go before the DGTPC (Govt. of Haryana) on 3rd Feb.’14  & explain their part about the said dues.  The members who have paid the share of their legal charges to Association, those cases have already been settled with the Govt. but we remain silent for defaulter members.
