THE STATUS OF CASE IN THE HON’BLE APEX COURT

Dear Members,

               With best of our efforts the case was listed on a Non-Misc. day i.e. 02.04.2013 but it did not come on Board on 2^nd & 3^rd April. Again on 4^th it did come on Board  and Judges heard the case, passed the order to all applicants to sit together and prepare points to submit on or before 22^nd April (next date of hearing). Pursuant to this, we sat together in at least three sittings, prepared the common points to be taken up on priority, circulated among all fellow applicants and submitted to Justices on 22.04.2013.

              

               After hearing Counsels for petitioners, applicants, Builder, Govt. of Haryana Authorities, etc, the Bench observed that earlier Court Commissioner was appointed  to look into various terms of references given to him, he has submitted his report. In the meantime the Counsel for Builder & Builder himself submitted that they have sufficient plots to give to each claimant provided they are demarcated properly, he came up with plan and Lay out plan and was ready to assist the Govt. authorities.

               In view of the emerging situation, Justices were inclined to pass directions to Director General Town & Country Planning Haryana to look into the matter, come with updated demarcation plan on next date of hearing i.e. the 9^th July, 2013. It was left open to DGTCP to prepare list of unauthorized occupants in the said area.

               It is a welcome development as the ball is now in the court of Haryana Government.
