    PART - I

    Dear All Affected allottes

    HAPPY NEW YEAR 2011


    WHITE PAPERS ON WRONG DOING/MISDEES OF OUR ASSOCIATAION IN TERMS OF ALLOTEES MEMBERS

    I would like to share some of my concerns / Views with our fellow members who are allottes. By doing this I would like to try you people under stand as to why and chronology of events which led to creation of Third party rights by colonizer.

    1 In the year 1996 when for the first time 492 peoples went to Supreme Court (who were basically defaulters) against colonizer and pleaded for allotment of plots although they were defaulter. Till that time the colonizer was doing every thing right towards the development of colony. As per the licenses awarded to colonizer he was suppose to develop the colony/ sell the plots as per this formula

    1 25% plots for EWS
    2 20% plots for NPNL upto 263 sq yards
    3 55% bigger plots for open category

    The colonizer in case of 492 people in supreme court admitted by the way of affidavit that he had already allotted NPNL plots to 1475 people who made full payment of land/EDC-IDC and executed agreement also. Colonizer also pleaded that since these 492 peoples are defaulter in terms of partial payments they are not entitled for plots. Never the less honorable Supreme Court turned down his plea and passed order to accommodate these 492 people carving additional plots from open category / bigger plots. Hble court also revised the lay-out plan accordingly.

    After seeing their success in legal battle many more associations / peoples started dragging colonizer in various courts over petty issues.

    When builder accommodated 492 people in NPNL category almost his 80 % of total plots came in NPNL category and he was left with only 20% plots from open category from he has to earn the profits in order to develop the colony. In fact it became unprofitable for colonizer to develop the colony. From here onwards he started to play the mischief and now result is in front of us.

    I would also like to seek the attention of fellow allottes about interest of our association in fighting our cause:-

    (A) From the day one our past president who is no more now said in each and every AGM or whenever member’s meat that, No allottes should go for sale deed or do any talks with the colonizer. He also use to say that when sale deeds will be undertaken, he himself and his ( idiots ) executive members will do it in last after all the deeds of

    ordinary members would get executed . But it happened exactly opposite recently when sale deeds of our supreme court petitioners were undertaken all executive members got it first including Mr Malhotra son and afterwards came the turn of ordinary members. Executive members paid nothing for Excess land while other members were forced to pay Rs 4500/- per sq yards extra.

    WHAT DOES IE SUGGEST?????????? Sincerity of executive members for their plots only.

    (B) From 1996 onwards when the CWP 876/1996 filled till date our past president/ Current sec only worked for cause of them self, I mean here Supreme Court petitioners only. Since 1996 till date they only concentrated for Supreme Court petitioners. When colonizer admitted in supreme court itself that we has no grievances with 1475 people to whom he has allotted plots after receiving full money, then why Mr Malhotra Din, nt allowed allotees to get their sale deed executed and get their legal rights established only because in that scenario allottes would have moved ahead of supreme court petitioners in terms of getting their plots whereas their fate was uncertain at that time. Even from 1996 till date they neither filled any case at any court to fight for the cause of allottes nor negotiated with colonizer to get their sale deed executed, where as allotees have contributed equally or more in terms of money to the association but THEY FOUGHT ONLY FOR THE INEREST OF SUPREME COURT PETIRIONERS.

    (C) Now even after 2007 when we came to know that colonizer has created third party rights with respect to allottes plots No solid/concrete step has been taken against the colonizer . In fact what they did – They even withdrew the solitary case from Hble Punjab and Haryana High court filled for allotees (What A GREAT THING) on pretext of setting of Court commission in supreme court petitioners case. Now what ever hope we have is the Court Commission report only where he has establish the entitlement of allotees also. But it remains to be seen in future developments in CWP 876/1996 pending In Hble Supreme Court that what relief allottes get from there based on court commission recommendations.


    There fore it is totally cleared from above mentioned facts that Late MR Malhotra/ Mr Pandey fought only for the cause of NON allotees / Themselves on the money colleted from allotees. Till date position is same and I would also like to mentioned that I have written all above things without having any personal Grudge against Either with Late MR Maltotra or Mr Pandey.



    I would also like and appreciate if MR Pandey would reply on this in blog only and would tell the allotees members only FIVE steps they have taken to safeguard the interest / Rights of ALLOTTES since 1996 till date.

  5. Happy New Year-2011 to all the plot holders of Phase-I & II and members of the association. The plot holders of phase-II are once again requested to visit their plot as no boundary is available at the site and the entire areas has been converted into a playground and new roads has been laid down by the near by colony’s in the Durga Builder land. Some of the illegal occupancy is already there and even one property dealer has constructed his office in Phase-II and even one building material supplier has also buildup his godown in the Phase-II. The encroachment in going their in piecemeal and if it is not stopped then at one time the plot holder of Phase-II will be left only with the Registry of their plot and the story of film of KHOSLA KA GHOSHLA will be at the site, as such all the members of Phase-II are requested to made request to the association for the early de-markation in Phase-II so that new boundary may be buildup at the plot and two security guard may be deployed at the site i.e. in Phase-I & II so that further encroachment by the local bad element be stopped. The Association is also requested to collect the money from the Plot Holders for de-markation of plots as well as for the payment of wages of two security guard. THIS MAY PLEASE BE TREATED AS MOST URGENT TO SAVE THE PLOT OF PHASE-I&II.

    you u can surely say that these encrohments are new one and on the plots of our members only.It can be on plots of people belonging to other associataions.

I have visited recenly the site and it is true that there is incrohments in block-J Phase-II that is why I am requesting all the plot holder of phase-II to vist their plot as there is no boundary available in size of 135 sqr yard. The member of assosiation has also visited the site recently and it is also in their knowledge. The de-markation of plot in phase-II is most urgent at present.
