Dear Members,

            So-called builder filed a list of 557 persons as encrocher before the Hon’ble Arbitrator in reply to our Affidavit dated 12/08/2018 referring the Annexure-I to V of Scrutiny Committee.  The said builder again forwarded a list of 441 persons  addressed to Hon’ble Arbitrator through mail on 08-09-2018 about encroaches wherein it is submitted that joint technical  survey of site was conducted along with the  DTP.

            Further so called-builder mentioned in the said mail letter that “..in light of revelations  made in the joint Technical Survey report and order passed by your lordships, it is now clear that Claimant Associations have committed large scale fraud by claiming plots through the means of present arbitration despite having occupied lands through encroachment…..”

            We gone through the said 441 list and found following 38 persons are belonging to our Association:

            It is very difficult to us check all names of list, however, members are requested to kindly go through the said list and make it sure that your name is added as encroacher or not to avoid any further complication. 
 
            The persons who still have not deposited their last dues of legal charges, their names will be placed on this Blog very shortly.

    With due respect to your position and status as the General Secretary of our association, I find the contents of your above report to be vague and totally misleading on the following grounds:-

    Who is this "so called builder" in this report?

    Are you and the elected office bearers handling our case in litigation for the past two and a half decades against any "so called builder" or Durga Builders Pvt. Ltd.?

    And then in your communique to us asking us to furnish to our arbitrator through you an affidavit the content of which is equally vague and misleading as this above report, requires the deponent to furnish a number from a list that again has been a part of a letter/communication to our arbitrator filed by the "so called builder" again, which none of us members of this association has seen.

    Which educated and sane person acting as a deponent, do you think, shall sign and file an affidavit based on facts reported by him/her from a document that he/she has never seen or been made to see?

    And you may please state here for the benefit of us members, as to why you have not posted on this website, that letter and the affidavit that you have separately circulated on Whatsapp? Why is this part here and part there communication?
