Request for e-mail.

Dear Sir,
Our various respected members informed that they have not received the letter of Association dated 16-07-2010 mailed to them through courier regarding AGM dated 01-08-10. It also came to our notice that the said letter was delivered to some members, over the date of AGM.
In view of above, we request to all our members to please send your e-mail address so that any important information be send accordingly.

  1. Our case is hearing and arguments in the Hon'ble Supreme Court are coming up on 16/08/2010. The Court Commissioner has also submitted his report to the Hon'ble court. It is requested that it may also be argued before the Hon'ble Supreme Court that Shri R. K. Nanda, M.D., M/S Durga Builders Pvt. Ltd., New Delhi, has reduced size of many Supreme Court petitioners, on its own, in violation of Supreme Court directives. Supreme Court petitioners had deposited the amount for a plot of size 134 Sq. yds. whereas the builder had reduced the size of plots to 99.50 Sq. yrds. without taking consent of the petitioners. Further, the builder has not refunded any amount to the reduced size plot holders. Instead, he adjusted the whole amount of 134 sq. yrds. for reduced size plots.

    It is requested that the above facts may please prominently be brought to the notice of Hon'ble Supreme Court.

    This stupid and malicious campaign against our association office bearers is uncalled for and totally wrong .Instead of appraising the efforts put By Shri MP Pandey and late Shri JS Malhotra, some members have started this un needed campaign at this Juncture . Its just because of their continuous zeal to fight this fraud builder, the case in supreme court has reached at this stage where a hope and light has started to appear that very soon we are going to get Justice finally after two decade of long and voluminous battle with durga builder.

    The present case which is in going on in supreme court and in which the commission was set up and all the wrong doing of Durga Builder and how he was helped by Haryana government in doing this had appeared on record before hnble supreme court has only happened by wise and honest approach taken by our association office bearers. If they had to shake hand with fraud Durga builder they would had done it long back and had made fortune long back.

    All the registries of Supreme Court petitioners which are pending for more than 10 years had executed by scamster Durga builder only due to coming in pressure after submission of commissioner report so that he can have some face saving in supreme court when case will come for argument. As far as allegation by some members that they got less area plot registered while they paid more money and that excess money has not been refunded by Durga Builder. These kind of cases are very less in compared to total number of our members whose plots have been registered, I have just to say them, that by losing some money they have at least became registered owner of plots while one should think about those people (I am also one among them) who had paid all money to durga builder and their plot have been sold to third party.

    There we should not put baseless, false allegations and personal attack on anybody at this crucial stage of our case as it will only dampen the sprit and confidence of our respected office bearers without whom efforts it would not have been possible to fight such a long and complex battle with Durga builder in which Haryana govt has also favored him. I also request all members to be united because unity is our strength and not the BLAME GAME.

    Instead of this blame game all supreme court members whose registry/s have been executed should look forward to protect their respective plots from unauthorise ocupation from local goons/anti social elements by getting the security guards there as suggested in AGM metting

    I totally endorse the views of sehgalji and Tortoise Ram. The all problems today which are faced by our fellow association members are Just because of wrong, untimely , one sided and foolish decisions taken By Late Mr. Malhotra Ji (God kindly forgive me for this) or Mr. Pandey JI. There are many instances but I am giving few of them here.

    A) In latest AGM meeting Mr. Pandey repeatedly tried to tell members about the registry of Supreme Court members as of their very big achievement as if they have done something impossible but the fact is way back in 1999 Supreme Court order Mr nanda (Durga Build) to execute the registries of all the petitioners who were in supreme court in 1996 consisting of some members of our association and rest of other associations. While members of others associations got their registries done. Mr Malhotra had some objections on method of Mr Nanda and the language of sale deed. They wasted 10 years for this in local Faridabad court for petty issue and result remained the same or I would say BIG ZERO and our gain is

    1 10 years wasted in local fbad court, precious money wasted, many of our members died during that period without hearing the outcome.

    2 Helped Mr Nanda Financially , He charged Rs 4500.00 per yard extra from members for increased area that too after so called bargain from 10,000.00 asked earlier . If we had got sale deed done in 1999 as other associations did. The extra charge would have been few hundred Rs then because in year 2000 the land price was very less. Therefore our association helped Mr Nanda to make Rs 5,00,0000( Fifty Lakh only) or may be more with their foolish decisions and lack of vision.

    B) In Every AGM meeting Mr Malhotra used to insist members not to get their sale deed done as builder has not done External development , his language is not right etc,etc ( very petty issues) and every allotte members obeyed Him , the outcome is

    1 The land price in faridabad started to increase exponentially after 2004. This lead to a situation where Mr Nanda sold plots to land mafia of Badarpur , executed sale deed in their favour and now our high court members have left with only piece of papers ( agreement to sell/ Allotment letter) , In turn Mr NANDA earned crores of Rs second time from same piece of land he sold earlier. Indirect help of MR NANDA or may be direct GOD Knows


    C) Mr pandey claims in every AGM that it is in our case and because of our efforts Supreme court constituted court commissioner after which all misdeeds of Mr nanda have been able to come in light where as the truth is

    1) Instead of asking for court commissioner inquiry with respect to our association members only they accepted for an open enquiry , What followed afterwards :- ALL people who were sleeping during all these years or who were not in any court or who never bother about their plots or who paid only partial money to builder, all of them in one stroke became eligible , their entitlement establish by court commissioner and recommended for plots to supreme court and interestingly our members paid expense of court commissioner. All Tom, Dick and harry got the fruit of commissioner report who were no where in picture.Net result is plots became less and claimant became more.


    There are so many other examples but I Think above mention points are enough for even a child to under stand that, These so called Corrupt Netas of our association are in glove hand with Mr Nanda . Their one and foremost objective is to drag the case for some more years NO????? No for SOME MORE DECADES.

    MR Nanda is 82 Now ?I think he is suffering for All diseases which happen to RICH PEOPLE . Every day he lives is like bonus to Him .one Fine Day he will leave this world and We poor people who had invested their hard earned money will get only

    TARIQ pe TARIQ only nothing more than that

    Be Vigilant about mischief activities of Our association CORRUPT NETAS.

  5. Due to delay in emerging positive outcome in our case the frustration and agony is understandable.The matter is in supreme court. I hope sooner or later we will emerge winner.

  7. Good Morning to all the members

    All members of Phase-I &II are requested to take up the matter with Shri Pandey regarding to fix up the immediate date for holding general body meeting at once to discuss the following points.

    (1) Our Advocates are not able to put the matter in a proper way in the Hon’ble Court i.e. the case is lying pending since 1996 in the court. (2) De-markation of the plots be made immediately, new boundary with one Room be made on the plot so that at-least possession of plots will be in the hands of the plot holder. (3) Let the concern authority may take their own time for the development of the land / plot. (4) One security guard in each phase may be engaged and deployed and be provided with a mobile connection so that he may contact the Association member if any encroachment is done by any un-authorized party. (5)Encroachment if any has been made at the land of phase-I & II by any un-authorized party that may be got removed with the help of concerned police / agency. (6) Funds for under point No. (4) may be collected from the plot holders and if any extra funds is required by the Association that may also be intimated to the plot holders.

    An action on the above points is to be taken at the earliest otherwise paper of registry will be in the hand of plot holder and plot will be in the possession of other party and the actually plot holder will be like a KHOSLA KA GHONSHLA
